Nearly seven years since the meltdown of 2008, we are still nowhere near getting private capital back into mortgages. The lavish executive salaries and anti-regulation lobbying are largely a thing of the past, but nothing has really changed with Fannie Mae and Freddie Mac because the government is now raiding Fannie and Freddie’s profits to pay for general government expenses. That’s great for the budget deficit, but no so great if there is another economic downturn and Freddie/Fannie suffer loses on over $5 trillion in outstanding securities.

Guide to 2014 Mortgage Servicing Rule Changes - Angel Reyes and Associates

On January 17, 2013, the Bureau of Consumer Financial Protection issued rules that amend the mortgage servicing provisions of Regulation X which promulgates the Real Estate Settlement Procedures Act.

These changes, effective January 2014, fundamentally alter the way servicing operations work. Servicing, which was once largely an operational issue will now become much more of a compliance issue subject to regulatory enforcement. Please keep in mind, certain provisions in the rules create new borrower rights that are enforceable through a private right of action.
